U.S. Supreme Court has ruled in Lucky Brand Dungarees Inc. v. Marcel Fashions Group Inc., a 19-year trademark dispute over the mark “Get Lucky”, that the defendant was not precluded from raising new defenses under the doctrine of res judicata.
